British cultural workers who are protected by the Withdrawal Agreement because they have already lived in Germany or another EU state since before 31 December 2020, can continue to work without restrictions in their country of residence. However, this freedom only applies in the country of residence. If they want to work and/or offer services in another EU state, the same conditions apply to them as to non-EU nationals. Shipping artworks post-Brexit – case study by J. Young As an artist living between the UK and mainland Europe, J. Young frequently exhibits art works in the EU. He is also co-operating a small pop-up gallery and curatorial project in the UK. “Before Brexit we ran a number of projects with countries in Asia (China, Hong Kong and Korea) (…) and were navigating customs systems on the other side of the world. Now that Britain has left the EU, we are in a similar position receiving artworks from mainland Europe as we were with the rest of the world.“ Withholding tax in Denmark and Luxembourg In many countries, withholding tax (a type of double income tax; another common term is “foreigner tax“) is levied for artistic performances or for the exploitation of rights of use. Sample invoices for artistic services abroad When artists based in Germany provide services (such as performances, lectures etc.) to clients based abroad, the question of whether these clients are businesses/cultural institutions/associations (B2B: Business to Business) or private individuals (B2C: Business to Consumer) makes a difference when invoices are issued. Two commented sample invoices for artistic services in other EU countries can be found here.
