Jurisdiction

The place of jurisdiction refers to the local competence of a court which determines the judicial district in which an action is to be taken in case of a dispute.
A jurisdiction clause declares a court responsible (through an express or implied agreement) which usually would not be responsible – for example, if one of the contracting parties is established abroad and has no place of general jurisdiction in Germany. The prerequisite for an agreement is that it is made between legal persons.
